Section 196
<br> which can withdraw the claim
In any case other than the case in which the Government of Nepal is dismissed, the party to the case withdraws the claim in the plaint, appeal or petition, or withdraws the plaint, appeal or petition on the grounds that he cannot prove his claim or the purpose of the claim has expired. He can apply to the court at any time before it happens.
(2) If a petition is received in accordance with sub-section (1), the court shall issue an order allowing the petition, appeal or withdrawal of the petition in accordance with the petition.
(3) According to sub-section (2), if there is an order to withdraw the petition, appeal or petition, the court shall hear the case.
(4) If a petition, appeal or petition has been withdrawn by someone in accordance with this section, the same person cannot file a complaint against the person who has been opposed to such petition, appeal or petition.
